Discuss the principles involved in writing Mental Health legislation. What difficulties do you forsee in practice? Illustrate your essay with reference to the management of different illnesses, including dangerous severe personality disorder.

The principles involved are autonomy, equality justice and non-malificence.Psychiatry is the only medical discipline which has special legal powers to detain and treat people against their willThis is because illness is deemed to impair decision making judgement and behaviour.Mental health legislation has been around for 200 years and is revised every 25 years ???

DEfining mental illness is important with tighter defnitions of impairment and psychopathic disorder.

A good starting point 8) would include analysing what exists, assesing weak points of current act, consulting users and carers, asking opinions of legal and policing professional and also looking at newer acts like the Scottish Incapacity act, the NewZealand Mental Heath Act and the Human Rights Bill.

It is important for clinicians to adopt proactive stances with courts and legislature. we should be aware of the legal focus on liberty whereas we are interested with the clinical focus on treatment >:( the criminal justice representation model which requires concentration on the rights of individual without regard to the rights of others

:-[ in the main body i will talk about individual illnesses and the necessary mha concentrating on the four ethical principles, consent to treatment ,, capacity and dangerousness.

Dementia and LD could be lumped into the incapacity act. Iwill also discuss rights to treatment,involuntary commitment to outpatient treatment and deprofessionalization of mental health service delivery and criminalization of involntary hospitalization ::)

I will speak strongly against the medicalization of psychopathic disorder and the need to stand against legislature we are forced to adopt :D

I will conclude by saying that we need to devise research to collect data to support our positions and that it is incumbent upon each psychiatrist to become aware of pitfalls involved in the provision of involuntary treatment and learn to operate in the foreign enviorment of law 8)
