Criteria for Appointment to the Specialist Registrar Grade in the NHS

All members of advisory appointments committees must act fairly in the short-listing and selection of candidates. In assessing an applicant's suitability for appointment there should be no discrimination, intended or otherwise, on grounds of colour, sex, religion, politics, marital status, sexual orientation, membership or non-membership of trade unions or associations, or ethnic origin. Relevant legislation includes the Race Relations Act 1976, the Sex Discrimination Acts 1975 and 1986, and the Disability Discrimination Act 1995

So this equality statement is irrelevant to IMG's

Froid, this is what royal college has to say about equal opportunities

'The College expects that members, associates and staff, when acting on behalf of the College, will treat all people equally whatever their race, colour, ethnic origin, national origin, religion, gender, age, sexuality, physical disability, mental disability or appearance.

Members, associates and staff expect to be treated fairly and not to be discriminated against either when dealing with each other or with other people who come into contact with the College'

I might be mistaken and interpreting it wrongly. There is mention of national origin in this statement. And I assume that the shortlisting panel does have members of the royal college. So if they don't shortlist other members based on their national origin, wouldn't it amount to discrimination?

I entirely agree with you but I guess rules are interpreted usually according to the convenience. Moreover if the home office explicitly states not to consider IMG's then it is the home office and not the Royal College that is discriminating.

Do not get me wrong...I am an IMG...but just trying to play the devil's advocate.

I am sure the college will cleverly revise the 'equal opportunities' statement such that it will still retain the moral highground of treating everyone equally...but some being more equal than others.

U r right Froid, Royal college will soon change its policies. I have written a letter to them, along with a copy of their own current equal opportunities policies, their own shortlisting criteria for Spr, current Doh guidelines and the letter I recieved from the Yorkshire deanery. Not that I am expecting them to go out of their way and come and help me, but nevertheless I am curious to know what their reply(if they bother to give one) would be!

No I think you are doing the right thing. We must write to all the authorities to atleast let them know that we have perveived the injustice and they cannot state later that it was done for our own and our parent countries' benefit .

I have recieved a letter of not being shortlisted for SpR (I have got another SpR job anyway) but I will still ask if the immigration related rule was one of the reason.

The equal opprtunities will continue to exist..believe me. What it would happen is that the equal opportunities would protect UK / EU doctors only. For example a UK citizen of ethnic minority status (say asian) would be protected against discrimination or say females would be protected ... but its spirit would have changed!! It would be a complete mockery but still there would be equal opportunities. It is all a play of words!!
